Terms and Conditions of Use

Article 1 (Purpose)
These Terms and Conditions of Use constitute an agreement between the user (hereinafter referred to as the “User” or “Users”, depending on the context) and Koreastamp and set forth the rights, obligations, and responsibilities of both parties in connection with the use of any and all internet-related services (hereinafter referred to as the “Services”) provided by Koreastamp on its platform (hereinafter referred to as the “Mall”), operated by Korea Postal Service Agency, the e-commerce service provider.

Article 2 (Definitions)
A. “Mall” refers to a virtual marketplace established by Korea Postal Service Agency to provide goods or services (hereinafter referred to collectively as the “Goods”) using ICT equipment and devices such as computers. It can also be defined as the company that operates Koreastamp.
B. “User” or “Users” refers to both members and non-members who engage in the Services provided by the Mall in accordance with these Terms and Conditions of Use.
C. “Member” refers to a User who utilizes the Services offered by the Mall by signing up for membership.
D. “Non-Member” refers to a User who utilizes the Services provided by the Mall without signing up for membership.

Article 3 (Display, Explanation, and Amendment of the Terms and Conditions of Use)
A. The Mall shall disclose the contents of these Terms and Conditions of Use, as well as the name of the business entity, name of the representative, address of the business establishment (including the address where consumer complaints can be addressed), telephone number, fax number, email address, business registration number, electronic commerce permit number, and name of the Privacy Officer on the landing page of the website of the Mall. However, the contents of these Terms and Conditions of Use can be accessible through a link page.
B. The Mall shall offer a dedicated page or pop-up window that allows the Users to review the critical details specified in the Terms and Conditions of Use, including information regarding contract cancellations, delivery responsibilities, and refunds, before giving their consent to these Terms and Conditions of Use.
C. In the event that the Mall makes any amendments to these Terms and Conditions of Use, it shall provide notice by posting the effective date and reasons for such an amendment on the homepage for a period of seven days until the day prior to the changes taking effect. If the amendment is disadvantageous to the Users, the Mall must allow a grace period of at least 30 days for notification. In this case, the Mall shall clearly indicate the contents both before and after the changes, making it easier for the Users to comprehend and understand them.
D. When the Mall amends these Terms and Conditions of Use, the amendment shall apply only to contracts that are entered into after the effective date of the amendment, and any contracts concluded prior to the effective date shall continue to be governed by the provisions of the previous Terms and Conditions of Use. However, if a User who has already entered into a contract wishes to apply the amendment and expresses his/her intention to the Mall within the notice period specified in Paragraph C above, the amended Terms and Conditions of Use will be applicable upon the consent of the Mall.
E. Matters not specified or interpreted in these Terms and Conditions of Use shall be governed by the Guidelines for Consumer Protection in Electronic Commerce, Etc. provided by the Fair Trade Commission and other related laws and regulations.

Article 4 (Provision and Replacement of the Services)
A. The Mall shall perform the following duties:
1) Providing information regarding the Goods and facilitating the conclusion of purchase contracts;
2) Delivering the Goods as specified in the purchase contracts; and
3) Fulfilling additional duties as determined by the Mall.
B. If the Goods become out of stock or undergo any revisions in technical specifications, the Mall may modify the details of or replace the Goods to be provided in the future. In such cases, the Mall shall immediately announce the replacement of the Goods and the anticipated availability date on the page where the current Goods are displayed.
C. If the Goods become out of stock or undergo any revisions in technical specifications, the Mall shall promptly notify the Users of the reasons for such.
D. The Mall shall provide compensation for any damages incurred as a result of the preceding paragraph. However, this provision shall not apply if the Mall can demonstrate that such events were not caused by intentional actions or negligence on its part.

Article 5 (Suspension of the Services)
A. The Mall may temporarily suspend the Services in the event of maintenance and repair, replacement, or damage to ICT equipment and devices such as computers as well as disruptions in communication.
B. The Mall shall provide compensation to a User or a third party for any damages arising from the temporary suspension of the Services due to the reasons set forth in Paragraph A above. However, this provision shall not apply if the Mall can demonstrate that such events were not caused by intentional actions or negligence on its part.

Article 6 (Sign-Up)
A. The Users can sign up for the Mall by completing the registration form provided by the Mall and subsequently expressing their intention to agree to these Terms and Conditions of Use.
B. The Mall shall register all Users who have submitted membership applications as stated in Paragraph A above, unless they fall under any of the following conditions:
1) The User provides false information or omits required information in the registration form; or
2) The Mall determines that the user registration would substantially hinder its technical operations.
C. The Members shall promptly update their account information on the Mall in the event of any changes.

Article 7 (Membership Withdrawal and Loss of Qualification)
A. The Members may submit a request for the withdrawal of their Mall membership at any time, and the Mall shall promptly process such a request.
B. The Mall may restrict or suspend membership in the following circumstances:
1) The Member poses a threat to the integrity of e-commerce, such as by causing disruptions to the use of the Mall by others or engaging in identity theft; or
2) The Member engages in activities prohibited by laws, these Terms and Conditions of Use, or acts contrary to public order and morals while utilizing the Mall.
C. The Mall may revoke membership if a Member, whose membership has been previously suspended or restricted, repeats the same act twice or more or fails to address the issue within 30 days.
D. In the event of membership revocation by the Mall, all Member-related information will be deleted. Prior to such revocation, the Mall shall notify the Member and extend a 30-day period to provide an explanation or clarification regarding the situation.

Article 8 (Application for Purchase)
A. The Users shall follow the subsequent or similar steps for making a purchase, while the Mall shall ensure the provision of the following information in a clear and comprehensible manner:
1) Browse and select the desired Goods.
2) Enter the recipient's name, address, telephone number, email address (or mobile phone number), and other pertinent details.
3) Review the information pertaining to these Terms and Conditions of Use, contract withdrawal limitations, and delivery fees.
4) Explicitly consent to these Terms and Conditions of Use and confirm or decline the provisions specified in Subparagraph 3 above.
5) Apply and verify the purchase of the Goods: I agree to allow the Mall to validate the application.
6) Select a payment method.
B. In the case where the Mall should provide or outsource the management of the Users’ personal information to a third party, it shall obtain their consent during their application for purchase. This consent shall be sought separately and not be obtained in advance during the membership sign-up process. When seeking such consent, the Mall shall specify the personal information items to be disclosed, information of the party receiving the information, purpose and intent of use, duration of retention and use, and other relevant details to the Users. However, regarding the outsourcing of the management of personal information pursuant to Paragraph 1 of Article 25 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, matters not governed by the provisions thereof shall be subject to other relevant laws and regulations.

Article 9 (Conclusion of Contract)
A. The Mall may not accept a purchase application specified in Article 9 herein if it falls under any of the following subparagraphs. When the Mall enters into a contract with a minor, it shall notify that the minor or legal guardian of the minor can cancel the contract if the consent of the legal guardian is not obtained.
1) In the case of false or omitted information entered in the form
2) Purchase of goods or services such as tobacco, alcohol, or other items prohibited by the Youth Protection Act
3) If deemed that accepting the application may cause technical problems to the Mall
B. The contract is deemed to be concluded when the acceptance of the purchase application by the Mall is delivered to the User using the notice of receipt specified in Paragraph 1 of Article 12 herein.
C. The acceptance by the Mall shall include confirmation of the User's application for purchase, availability of the Goods for sale, and correction or cancellation of the purchase application.

Article 10 (Payment Methods)
The payment methods for the Goods purchased through the Mall may be selected from the following subparagraphs. The Mall will not charge any additional fees regarding the payment of the Goods.
A. Card payment using debit card or credit card
B. Other electronic payment methods

Article 11 (Receipt, Modification, and Cancellation of Application for Purchase)
A. Upon a User submitting an application for purchase, the Mall will promptly send a receipt notification to the User.
B. The User may modify or cancel the application for purchase immediately after receiving the notice of receipt from the Mall in the event of any inconsistency between the User’s intention and the notice. If the request for modification or cancellation is made prior to delivery, the Mall must promptly handle the request without any delay. In cases where payment has already been made, both parties shall adhere to the guidelines provided in Article 15 “Effects of Purchase Cancellation” herein.

Article 12 (Provision of the Goods)
A. Unless otherwise specified, the Mall shall take necessary measures, such as customization and packaging, and deliver the Goods within 10 days from the date of purchase. However, if the Mall has already received full or partial payment, delivery shall be processed within 7 business days from the date of payment. In this case, the Mall shall take necessary measures to inform the User of the provision procedures and delivery progress of the Goods.
B. The following are the shipping fees and periods for the Services provided by the Mall:
1) The usage fee for postal services shall adhere to the regulations established by EMS.
2) The shipping fee for products shall be borne by the User.
3) The shipping period shall commence from the following date of payment approval and be calculated in accordance with international postal delivery standards.
4) In the event of force majeure, such as natural disasters or COVID-19, the corresponding period shall be excluded from the total delivery days.
5) If the User incurs financial losses due to the intentional acts or negligence of the Mall in relation to delivery, the User may be eligible for compensation according to the standards and procedures set forth in the Postal Service Act.
C. The customs clearance procedures and shipping standards associated with international delivery shall adhere to the laws and regulations of the respective country.
D. The Mall shall specify the delivery method, payer information, and estimated delivery time for the Goods purchased by the User. In the event that the Mall surpasses the agreed-upon delivery period, it shall compensate the User for any consequential damages, unless the Mall can prove that there was no intention or negligence on its part.

Article 13 (Refund)
In the event that the Goods are sold out or unavailable and cannot be provided or delivered to a User who has applied for purchase, the Mall shall inform the User of the situation without delay. For the Services that have already been provided, the Mall shall either issue a refund to the User or take appropriate measures as required within 7 business days from the date of receipt.

Article 14 (Customer Information Modification and Cancellation)
A. Customer information modification and cancellation are available on the website until 23:59 on the day following the purchase. Once the items have entered the shipment preparation phase after this timeframe, information modification and cancellation are not possible.
B. The User is not eligible for returns or exchanges if the Goods fall into any of the following categories:
1) The Goods are lost or damaged due to the User's responsibility (excluding cases where the packaging is damaged solely for the purpose of inspecting the contents of the Goods);
2) The value of the Goods has significantly diminished due to partial use or consumption by the User;
3) The value of the Goods has substantially diminished over time, rendering them unsuitable for resale; or
4) The Goods have been exchanged for items of equivalent performance but with impaired original packaging.
C. Exchanges prompted by a User change of mind are not permitted, and the round-trip shipping cost will be deducted from the amount to be refunded.
D. If exchanges cannot be accommodated due to inventory constraints, despite User requests, a refund shall be initiated. In the case of defective goods, a complete refund will be issued, while for non-defective goods, the refund amount will be adjusted to account for the incurred round-trip shipping costs.
Article 15 (Effects of Purchase Cancellation)
A. Upon receiving returned Goods from the User, the Mall shall initiate the refund process within 5 business days, reimbursing the payment received for the Goods.
B. In the event of a delay in the refund process, the Mall shall compensate the User at the overdue interest rate specified in the Act on the Consumer Protection in Electronic Commerce for the number of days the refund is overdue. However, if the User has made the payment for the Goods using a credit card or electronic payment method, the Mall shall promptly request the service provider of the payment method to suspend or cancel the payment.
C. In the case of contract withdrawal, the User shall bear the cost arising from returning the Goods. The Mall shall not impose any penalties or claim damages as a result of the User's decision to withdraw from the contract. However, if the User withdraws from the contract due to discrepancies between the Goods and their description or advertisement, or if the Goods fail to meet the contractual obligations, the Mall shall cover the cost of returning the Goods.
D. When the User bears the shipping cost associated with receiving the Goods, the Mall shall provide clear information regarding the party responsible for the shipping cost in the event of contract withdrawal.

Article 16 (Protection of Personal Information)
A. The Mall shall gather only the essential information required to provide the Services.
B. The Mall shall not collect information necessary for the execution of the purchase contract at the time of membership sign-up. Nevertheless, if personal identification becomes necessary prior to carrying out the purchase contract, the Mall shall collect only the bare minimum of personal information required to adhere to applicable laws and regulations.
C. The Mall shall seek the User's consent for the collection and use of personal information by notifying the collection and purpose behind such use.
D. The Mall shall refrain from utilizing the gathered personal information for any purposes other than those originally intended. In the event of new purposes for its use or sharing with a third party, the Mall shall inform the User of the intended purpose of use during the disclosure stage and acquire the User’s consent. However, exceptions to this provision may apply as stipulated by relevant laws and regulations.
E. In cases where the Mall is required to obtain the User's consent pursuant to Paragraphs B and C above, it shall specify or notify the User with the contact details of its Privacy Officer (including affiliation, name, telephone number, and other contact information), purpose of collection and use of information, and information about any third-party recipients (including the purpose for receiving the information and specific data to be shared) in accordance with the provisions stipulated in Paragraph (2) of Article 22 of the Act on Promotion of Information and Communications Network Utilization and Information Protection. The User may withdraw consent at any time.
F. The User may request access to the User’s personal information held by the Mall and correction of any inaccuracies at any time, and the Mall shall take the necessary actions without any delay to address such requests. If the User requests correction of an error, the Mall shall not use the applicable personal information until the correction is made.
G. The Mall shall maintain at least the minimum number of individuals authorized to handle personal information in order to safeguard its protection. The Mall shall bear responsibility for any damages arising from the loss, theft, unauthorized disclosure, alteration, or leakage of personal information, including credit card and bank account details, to third parties without the User's consent.
H. The Mall or any third parties who have received personal information from the Mall shall promptly dispose of all personal information once the intended purpose of its collection has been fulfilled.
I. The Mall shall not pre-fill consent forms for the collection, use, and provision of personal information. The Mall shall specify the Services that may be restricted in the case where the User declines to provide consent for the collection, use, and provision of personal information. The Mall shall not limit the Services or reject membership application solely based on a refusal to consent to the collection, use, and provision of personal information, except in cases where providing mandatory information is necessary.

Article 17 (Obligations of the Mall)
A. The Mall shall not engage in any acts prohibited by laws and regulations and these Terms and Conditions of Use, or act contrary to public order and good customs. The Mall shall make its continuous and best efforts to provide the Goods and Services in accordance with the provisions of these Terms and Conditions of Use.
B. The Mall shall establish a security system to protect the personal information of Users, including credit information, and provide an environment for Users to use the Services safely and securely.
C. In accordance with Article 3 of the Act on Fair Labeling And Advertising, the Mall shall be responsible for compensating Users if they suffer damages caused by unfair or deceptive labeling or advertising regarding specific Goods or Services.
D. The Mall shall not send commercial emails for profit-driven purposes to Users who have not expressed their desire to receive such communications.

Article 18 (Obligations for Member ID and Password)
A. Except for the circumstances stated in Article 17 above, the Member shall be responsible for managing the ID and password.
B. The Member shall not allow any third party to use the ID and password.
C. If a Member becomes aware that the ID and/or password has been stolen or is being used by a third party, the Member shall immediately notify the Mall and adhere to any instructions provided by the Mall.

Article 19 (Obligations of the User)
The User shall refrain from engaging in the following actions:
A. Providing false information during the application or modification process;
B. Utilizing the personal information of other individuals;
C. Modifying information displayed by the Mall without proper authorization;
D. Transmitting or posting information (including computer programs) other than the information provided by the Mall;
E. Violating the copyright or other intellectual property rights of the Mall or third parties;
F. Causing harm to the reputation of the Mall or disrupting the business operations of the Mall or third parties; and
G. Disclosing or posting obscene or violent messages, images, audio, or any other information that contradicts public order and good customs.

Article 20 (Copyright and Limitation of Use)
A. The Mall shall hold the copyright and other intellectual property rights to the works it creates.
B. The User shall not reproduce, transmit, publish, distribute, broadcast, or otherwise commercially exploit the information belonging to the Mall without the prior consent of the Mall.
C. If the Mall uses a User's copyrighted materials based on an agreement, it shall notify the respective User accordingly.

Article 21 (Resolution of Disputes)
A. The Mall shall make efforts to consider and address any opinions or complaints submitted by a User under the aim of resolving any resulting damages.
B. The Mall shall give priority to opinions or complaints received from Users. However, if the prompt handling of the matter is difficult, the Mall shall immediately notify the User of the reasons and provide an estimated timeline for resolution.
C. If a User seeks damage redress regarding an e-commerce dispute between the Mall and the User, the matter may be referred to arbitration by the Fair Trade Commission or a dispute reconciliation service designated by the mayor or governor.
 
Article 22 (Jurisdiction and Governing Law)
A. The jurisdiction for any and all e-commerce lawsuits between the Mall and a User/Users will be determined based on the User's address at the time of filing. However, if the address is unknown, the jurisdiction will be the exclusive jurisdiction of the district court in the area where the defendant is located. In cases where the User's address or domicile is not clearly identifiable at the time of filing, or if the User is a resident of a foreign country, the lawsuit shall be filed in the competent court as stipulated by the Civil Procedure Act.
B. Any and all e-commerce lawsuits filed between the Mall and a User shall be governed by the laws of the Republic of Korea.
